(A speculator bought half for a thousand for a zakat(1)[(2)], and sold it for two thousand, and bought a slave with it, and lost it in his hand. [The speculator] fined (3) a quarter of them, and the remaining owner, and a quarter of the slave goes to the speculator, and the remainder is hers, and the capital is two thousand five hundred, and he wins on two thousand only): That is, he bought a garment for a thousand, sold it for two thousand, and bought (4) a slave for two thousand, and did not pay them to the seller, until it was lost. The two thousand (5) are in the hands of the speculator. The speculator is fined a quarter of two thousand. Because it is the property of the speculator [(6)], and the owner is three-quarters, so if he pays it, the capital becomes two thousand and five hundred, because the owner of the money first paid a thousand, then he paid one thousand and five hundred, and if he sold it on a profit-paying basis, he says, Ali paid two thousand. And he said: only; That is, he does not say that two thousand and five hundred rose against me. Because the purchase occurred for two thousand (1), it does not include the loss that occurred due to the loss in the hands of the speculator. (If it was sold for double, it would be considered three thousand, and the profit from it would be half a thousand between them): That is, if it was sold for four thousand, then three thousand is the share of the speculation, and the thousand belongs specifically to the speculator, then three thousand (5) of which the capital is paid, which is two thousand five hundred, so the profit remains five hundred, half of which belongs to the owner of the money, and half to the speculator.

(And if he bought a slave [(1)] from the owner of the money for a thousand slaves, he would buy it for half of it and gain half of it [(2)]), so his saying: He bought it for half of it is the description of a slave (3), and the pronoun of the subject of his purchase refers to the owner of the money. If the speculator sold it on a profit margin, he would say: Ali paid half a thousand. (And if it was mixed[(2)] without his action, he shared it, and if he removed[(3)] the transgression, his guarantee is removed. Just as if he placed it in another house, then returned it to a house in which the owner ordered it to be kept, the guarantee is removed. That is, if the deposit was such that if it were destroyed, it would be guaranteed, then (4) this meaning is removed. We only said this; Because it is not possible for the warranty to disappear. Because the reality is that the guarantee disappears after the loss, and after the loss the transgression cannot be removed, and according to Al-Shafi’i (5) [(6)] - may God be pleased with him -: If the transgression is removed, the guarantee is not removed.

(And if the usurper [(1)] deposited the deposit, he is liable for whichever of them (2) he wishes. This is by agreement, so they compare the depositor of the depositor to the depositor of the usurper. If the depositor pays to the foreigner, he becomes the usurper. The difference (3) Abu Hanifa[(4)] is that if the depositor pays to a third party, he is not liable for what he has not separated from, so if he separates, abandoning the safekeeping, then he is liable, [and does not guarantee] (5) the other; Because he was deposited where the other was absent (6) and there was no work for him in that, like a garment thrown by the wind on a person’s lap.
